Description of Job

The Work Unit:

The Compliance and Enforcement Program of the Air Pollution Control Division (“Division”) conducts compliance evaluations (i.e. inspections) and stack test oversight, reviews source submitted reports, provides compliance assistance, provides oversight of local agency contracts, and conducts enforcement actions as appropriate for stationary sources in Colorado. These responsibilities are divided into two functional sections: The Compliance Monitoring Section and the Enforcement Section. The Enforcement Section implements the Division’s enforcement program by reviewing noncompliance determinations referred for enforcement from the Oil & Gas Program and the Compliance and Enforcement Program, initiating enforcement actions, and negotiating/resolving enforcement actions with regulated entities. The Enforcement Section is also responsible for evaluating submissions made to the Division under the Colorado Environmental Audit Privilege and Immunity Law.

What you will be doing

Under the direction of a supervisor this intern position supports the Oil & Gas Program and the Compliance and Enforcement Program. The position performs research, drafts enforcement documents, maintains evidence and other information related to enforcement actions, participates in negotiation and settlement of enforcement actions, and ensures and facilitates the timely resolution of enforcement actions. This position also reviews and evaluates requests for penalty immunity received pursuant to the Colorado Environmental Audit Privilege and Immunity Law.

Job Duties:

Prepare Enforcement Documents

Under the direction of the supervisor, prepares enforcement documents, including but not limited to Compliance Advisories, Notices of Violation, Compliance Orders, Cease and Desist Orders, Early Settlement Agreements, and Compliance Orders on Consent. Reviews inspection reports and stack test memos generated by field staff and verifies each violation of federal and state regulations, statutes and permit conditions. Drafts the enforcement document, ensuring that all evidentiary and other legal standards are met and that consistent legal language is presented. Works closely with the Enforcement Unit Supervisor in completing all tasks.

Evaluates Self-Disclosures

Under the direction of the supervisor, evaluates assigned self-disclosures submitted under Colorado’s environmental audit law. Considers statute of limitations concerns and analyzes statutory requirements for penalty immunity. Coordinates with technical staff, including permit engineers and field inspectors, in evaluating scientific data submitted by sources. Makes immunity and enforcement recommendations to the supervisor and management.

Track Enforcement Cases

Under the direction of the supervisor, tracks the status of each assigned enforcement action and coordinates with the supervisor, other Enforcement Advisors, and other Division staff. Develops and maintains appropriate tracking tools to analyze data and prepare summaries for management. Notifies the supervisor when backlogs or other productivity issues arise to ensure enforcement actions are initiated and resolved in a timely manner such that statute of limitations concerns are addressed. Prioritizes High Priority Violation (HPV) cases in order to meet EPA requirements.

Training and Information Sharing

Participates in relevant training to learn and maintain necessary skills and technical knowledge. Provides information to others, including the general public, about air regulations and Division procedures.

Other Duties as Assigned

Attends meetings, serves on task forces or teams, completes projects, and performs other duties as assigned by the supervisor.

MINIMUM QUALIFICATIONS:

Experience Only:

Four (4) years of relevant experience in environmental studies/science, political science, public administration, or a closely related field.

OR

Education and Experience:

A combination of related education and/or relevant experience in environmental studies/science, political science, public administration, or a closely related field equal to four (4) years

PREFERRED QUALIFICATIONS

In addition to the minimum requirements, the successful candidate in this position will have the following experience:

  • Strong organizational skills and attention to detail

  • Ability to work with teams; excellent interpersonal skills

  • Initiative and self-management

  • Outstanding verbal and written communication skills

  • Strong analytical skills; the ability to synthesize, interpret, and report on complex or technical information

  • Experience with Microsoft Office (Word and Excel)

  • Knowledge of and experience enforcing or ensuring compliance with environmental regulations
